Harry Potter Fanart Theft

Hey, flist. Can we talk?

'Cause, see, after yesterday's glorious Dumbledore announcement, I went surfing on google to relive the olden days. I found some of my favorite artists and fic writers all over again, gleefully cackled at all the crack. Thems were good times. And then I saw this link to a website with a fairly innocuous name that I didn't recognize. When I clicked, it came up as this site that was all about Harry Potter Hentai. I lol'd.

And then everything started to look a little bit too familiar.

ORIGINAL: "Woman Eater" by duckpuppy - now defunct because her livejournal pics were deleted with her journal - based off of this story by [livejournal.com profile] switchknife back in 2004. I can't find a full link, because I have no idea where the former duckpuppy's gone these days, but I think the story kind of speaks for itself in that manner.

ORIGINALS: "Ginny/Hermione, Parvarti/Padma" and "Ginny/Hermione, Bellatrix/Narcissa" by [livejournal.com profile] sherant, both for [livejournal.com profile] pornish_pixies, the second one's recipient being [livejournal.com profile] mytilene.

ORIGINAL: When Push Comes to Shove by [livejournal.com profile] ponderosa121 for the [livejournal.com profile] pornish_pixies fantasy fest, recipient [livejournal.com profile] luna_k. The post's since been deleted because of ponderosa's suspension, and her website is down for upgrading, so I can't find a link to the full picture, but [livejournal.com profile] luna_k describes it pretty accurately as: "Ginny/Luna, dubious consent, an uncomfortably large strap-on, and a hairbrush used in an interesting way."

For all I know, some of the others might be stolen as well. I didn't recognize any, but I also haven't been in Harry Potter fandom for a few years now.

My first thought when I found this was to try and contact someone who would know how to go about dealing with all of this, but - well, I know livejournal isn't sending me my comments. Then, I poked around and found [livejournal.com profile] art_theft. I'm trying to become a member so I can post all of this there, but it's slow going, and who knows if I'll even get the email telling me I've been accepted. I haven't received friend notifications all day.

So, what I need you to do, beloved flist, is going over to this site or this site and see if there's anything else you maybe recognize. If there's not, but you know how to get in touch with duckpuppy or [livejournal.com profile] ponderosa121, that's great too, because god knows my googlefu failed me on the duckpuppy front. And, finally, if you're already a member of [livejournal.com profile] art_theft, would you be willing to post this info there for me?

I think this is a bit urgent only because the people at that site are (trying to) making money off this, which is just. Insane. And bad. Bad, bad, bad! Copyright laws level of bad! Any help you guys can give would be really appreciated. I'm off to email [livejournal.com profile] sherant now.

Wow. Just.... WOW. See, I've seen plagiarised art and fic, but never before have I seen a fucking adult site stealing the art and charging people to see it! That's the worst thing EVER. God, I hope these artists are able to get them taken down because I know if I'd drawn anything and someone stole it and charged people to see it? I'd be spitting TACKS!!!!

I wonder if JKR's publishers can do anything about it? They're selling HP stuff...

Yeah...I don't think that JKR would really do good to get involved, because then there'd be the whole issue of fanart itself and if it violates copyright and - well. I dunno, I'm not really sure if there's anything to be done on the whole. Ponderosa says below that she's had this happen before, but I'd never heard of it, so I guess I thought this was an isolated event?

The internet kind of makes me sad, Elle. :(

I hate that this happens. Why can't people have a little bit of basic human decency?? :( Only this morning someone on my friends list posted about how 53 people downloaded her upload of SPN 303, when only 12 (twelve!) people had access to the link. Why are people so NASTY?

Christ. I admit to every once in a while downloading a song off someone's LJ without commenting - I'm BAD at commenting. But it's only once in a while and I usually comment on that person's journal often enough that I can later say, "HEY I dug that song, man!" Just. It's not that hard to be courteous on the internet! D:

I went to ponderosa's journal at insanejournal and left her a comment with a link to your post. Hopefully she gets it soon.

I know that duckpuppy took off all her X-rated art from her website because she was having trouble with underage people, I think...something bad happened. And she kind of never came back...maybe she just took it all off and decided to let it go.

But that is some seriously fucked up stuff :\

Thanks for giving me the heads up, but it's kindof a dead end. I've had this happen a few times over, mostly with yaoi art being sold on "gay toon" sites. It's almost impossible to get them to remove/cease without backing up the request with legal action. Although things like this violates the non-commercial part of my redistribution license, personally, since it's an audience I'll never market to, I'm not all that bothered.

But still, I'm a big fan of yours :) I just hate to see something like this happen to someone so talented, who has already been through so much crap with the internet.

First of all, I'd like to apologize, because I think there's been a misunderstanding on my part. I read your terms of use on your website and I thought that I had followed them -- the image has not been altered save for the graphic title added to it, and I did add a small tag at the bottom of the image claiming copyright to you. Furthermore, I added a disclaimer at the bottom of the sidebar, which you can clearly see.

I used your art because a) it's simply beautiful and b) I thought the terms you set forth on your website gave me the right to use the art. My site is neither a selling anything nor am I claiming the art is mine.

If you wish me to take down the offending art, I can. I'm sorry that this has created such a stir. I've been a fan of Harry Potter fanart for years and years and I know that artists have little say in how art is redistributed on the internet when it's so simple to copy and paste something. Please know that I am not trying to be a bad guy, though. I only wanted to write something here because I keep finding this in my referrals and it fills me with sadness to know people out there, even in the depths of the internet, think of me as a thief.
